Washington D.C.’s 9th U.S. Circuit Court of Appeals is without a doubt the most liberal court in the country. At 12,000 cases, the court hears twice as many appeals as the next largest circuit court per year. The 9th Circuit doesn’t just have the largest caseload, though, it also has the largest geographic jurisdiction spanning an area from the arctic circle to the grand canyon. About one-fifth of the country’s population is governed by this court.
Because of this large jurisdiction, the long docket makes for lengthy turnaround times in decisions and can make access to the courts challenging for an average citizen. This same problem caused the 5th Circuit Court of Appeals to be split into two appeals courts in 1981. Alabama, Georgia, and Florida were removed from the 5th Circuit and re-established as the 11th U.S. Circuit Court of Appeals.
According to Republican Rep. Darrell Issa, the court has become too unwieldy to operate efficiently. This caused a House panel to hold a hearing on possibly splitting the 9th U.S. Circuit Court of Appeals Thursday morning. The 9th Circuit is recently serving as the primary antithesis to President Donald Trump.
Via Red State Watcher:
On Thursday a House Committee begun the discussion of potentially splitting the 9th U.S. Circuit Court of Appeals.
Three 9th Circuit judges, including Chief Judge Sidney Thomas, Judge Alex Kozinski, and Judge Carlos Bea gave testimony before House Committee on the Judiciary Subcommittee on Courts, Intellectual Property, and the Internet. All three judges, like most of their 9th Circuit colleagues, support the current configuration and oppose splitting the court.
With the judicial system attempting to take over the legislation in this country, the current configuration has been very useful to them. Imagine a group of kids play “king of the hill,” if you were to ask the current “king” if he would please slide over so you could cut his hill in half, that way others could have better access to the benefits of said hill, you would promptly be pushed off. It’s the same with these judges; they have a very lucrative position in the largest court in the land, and they love their ability to skirt the normal checks and balances system of our law making process. What is a pretty sweet gig for them is trouble for the American people. Unfortunately, you can bet your bottom dollar that they won’t go down without a fight.
