From Conservative Tribune: Following a year-long investigation, the House Armed Services Committee confirmed what the Government Accountability Office had already determined and most of the American people already knew — the swap of five Taliban leaders in exchange for the return of captured Army Sgt. Bowe Bergdahl was against the law.
According to The Hill, the House report makes clear that the Obama administration willfully violated a law that required at least 30 days notification to Congress before any detainees were transferred out of the Guantanamo Bay detention facility.
The administration gave Congress only a few hours heads up before conducting the swap.
Furthermore, the report determined that the Obama administration deliberately misled members of Congress, the Defense Department and the media in order to conduct the ill-advised prisoner release of five senior Taliban leaders.
“At the time, there were rumors that on-again, off-again talks about a prisoner exchange, which had broken down several years earlier, might be underway again, but the administration repeatedly suggested to reporters and to Congress that nothing significant was going on,” the report stated.
The report also revealed that certain Defense Department officials who would typically oversee the transfer of detainees were kept out of the loop, ostensibly out of fear that they would leak the proposed swap.
“Our report finds that the Administration clearly broke the law in not notifying Congress of the transfer,” said committee chair Rep. Mac Thornberry.
“Leading up to the transfer, DOD officials misled Congress as to the status of negotiations. Pentagon officials best positioned to assess the national security risks were left out of the process, which increases the chances of dangerous consequences from the transfer,” he continued, adding that it was “irresponsible” to release these terrorists back to the battlefield in order to advance the political agenda of clearing out and closing Guantanamo Bay.
Of course, the White House stands by the decision.
“There was a unique opportunity that was presented to rescue Sgt. Bergdahl and that is exactly what we did,” White House spokesman Josh Earnest said.
Meanwhile, five senior Taliban leaders were allowed to return to the fight in exchange for an alleged deserter currently awaiting a trial regarding his misbehavior that placed lives at risk.
We all knew at the time that the swap of prisoners was a bad deal, but now we know for sure that it was also an illegal deal that never should have occurred.
It would be nice if the administration were held accountable for deliberately deceiving Congress and the American people, as well as providing aid and comfort to the enemy, but we won’t be holding our breath.
