President Barack Obama has issued a new order for the Border Patrol not to arrest drunk drivers because driving while impaired is not a federal crime.
The notice, “Enforcement With Alcohol-Impaired Drivers,” directed the 4,000 U.S. Border Agents in the Tucson, Arizona area to release anyone who they stop who is drunk.
According to the Department of Homeland Security, if an inebriated person goes on to kill someone in a traffic accident, the Border Patrol agent would not be not liable.
“There is no legal requirement for a Border Patrol agent to intervene in a state crime, including DUI,” read the DHS order. “Therefore there is generally no liability that will attach to the agent or agency for failing to act in this situation.”
Worse yet, not only is the Border Patrol not to detain the individual, but according to the memo they might even be liable if they do.
“There is no duty to detain the alcohol-impaired individual,” read the memo. “But if you do this option can raise potential liability for the agent or agency.”
This order has not been well received by agents.
During fiscal year 2014 the Border Patrol around Tucson recorded 87,915 apprehensions and seized 971,180 pounds of marijuana in addition to large quantities of cocaine, heroin and methamphetamines (H/T Judicial Watch).
It is criminal that Obama is directing the U.S. Customs and Border Patrol to ignore drunk drivers, and it’s not surprising that agents aren’t happy about the order. Neither is anyone else with any common-sense.
Except the drunk drivers, of course.
