‘The Obama administration was barred’… music to my ears. I wish I heard these words much more often. Anyway, a judged barred the Obama administration from forcing public schools to allow transgender students use whichever bathrooms and locker rooms they wanted. The judge argues that Obama’s stupidity and policy threatens students’ safety and privacy.
GLBT have turned the use of bathrooms into a fake Civil Rights issue saying that safety in the bathroom is less important than comfort of a transgender going to the bathroom. While the U.S. Dept. of Ed. have instructed schools to not ‘discriminate’ on the basis of gender identity, it missed the entire point of bathroom safety. The new directive invites the creation of all kinds of safety issues for school bathrooms when students aren’t using restrooms matching their gender at birth.
“This case presents the difficult issue of balancing the protection of students’ rights and that of personal privacy when using school bathrooms, locker rooms, showers, and other intimate facilities, while ensuring that no student is unnecessarily marginalized while attending school,” U.S. District Judge Reed O’Connor said. “The resolution of this difficult policy issue is not, however, the subject of this order.”
Is the right to use whichever bathroom you please a Civil Right’s issue or is feeling safe while you are in such a vulnerable position a Civil Rights issue? To be honest… I can’t even believe we’re having this conversation on bathrooms. This ruling doesn’t apply to schools who already accommodate transgender students nor ongoing court cases. But it’s a step in the right direction to sanity.
