Sheriff Blocks US Marshals Illegal Seizure, Orders Them Off Property [VIDEO]

A New Mexico Sheriff is standing up for one of his residents and the Constitution – having already sent US Marshals packing following a tense confrontation and later telling the IRS he will not allow a sale of property to move forward until all appeals are exhausted.

Sheriff Scott London of Eddy County was drawn into the situation just before Christmas when members of the U.S. Marshals Service kicked in the door of an apartment with guns drawn. At home was tenant Wilson Baughman, a young mother and her 1-year-old.

“There was extremely loud banging at the door and I could hear other people surrounding my house,” Baughman said.

Called by Baughman’s parents to intervene, Sheriff London stood between her and the Marshals, ordering them to leave. London reminded the Marshals that the case was still under appeal and his residents deserved due process. The Marshals threatened to arrest Sheriff London yet he refused to back down and the federal agents ultimately retreated.

“It’s my oath. I took an oath to support the constitution of the United States as well as the constitution of New Mexico and I felt bound to my oath,” Sheriff London said.

“I’m very proud of him. Not very many people have the courage to stand up against an organization that’s as large and powerful as the IRS,” Baughman said.

The appeal is still pending, but on February 19th the IRS intends to auction off three of the owner’s homes in Carlsbad. The sheriff sent the following letter notifying the IRS that he will not allow the sale to move forward as he believes it to be a violation of the 5th Amendment’s right to due process:

“Many officers have stood up over the years for the rights of citizens being victimized by the federal government,” Sheriff Richard Mack, founder of the Constitutional Sheriffs and Peace Officers Association, said. “But Sheriff London is the first one to stand up to the IRS since the early 1990s.”

Sheriff Mack is calling for the IRS to start following the law, including no “random” audits without probable cause, as they violate the Fourth Amendment. He asks them to stop committing crimes and rewarding IRS employees with bonuses for cheating on their personal taxes. “I agree with Senator Ted Cruz and others who say the IRS should be abolished,” said Mack. “It’s time they got off the backs of the American people.”
