This is one of those stories that gives you a glimpse into how messed up the justice system is in some parts of the country. Specifically Democrat run areas.
A teen gang member who carjacked a vehicle with a small child inside was found to be “mentally incompetent” and released from custody. The teen went on to murder a 50-year-old man at a gas station in Atlanta last month.
The man who was killed, Anthony Brooks, had recognized Charlie McDaniel, 16, and his brother Isaac, 15, as car thieves and he began yelling it out while at a Shell Gas Station in Atlanta. Charlie McDaniel was the one who had stolen the car with the kid inside.
Charlie then began pushing Brooks and pulled a gun. According to prosecutors, Isaac McDaniel opened fire on Brooks, and then Charlie apparently began firing, also.
The two brothers are known members of the street gang, “Down for Whatever,” or DFW. Atlanta Police officer Leon Delain told Fox 5 Atlanta that as Brooks was yelling out that the brothers were the two guys who were stealing everyone’s cars, a witness warned him to be quiet or they would shoot him.
Unfortunately, that’s exactly what happened.
The brothers have been arrested for over 30 crimes, including auto-theft and robbery. They both will now be charged with murder.
Now, here’s where it gets interesting. Charlie stole the car with the kid in it in a little over a year ago. WSB-TV Atlanta looked into Charlie’s court files when he and his brother were arrested for murder last month. Today they released what they found.
When Charlie stole the car, Malcolm Milliones, the father of the child, jumped onto the vehicle in an attempt to stop Charlie and save his son. The child was able to jump out of the car at some point, and Milliones was injured when he fell off as the vehicle was moving.
Here is video of the moment Milliones jumped on the car as Charlie was stealing it.
Charlie was charged with robbery, kidnapping, aggravated assault and aggravated battery. Because he was declared mentally incompetent, and the Atlanta juvenile justice system lacks resources, a judge put his case on hold and released him. That allowed him to continue committing crimes, leading up to the murder of Brooks.
More than a year earlier in the Milliones case, records suggest Charlie McDaniel basically admitted involvement but denied driving the car with the boy inside.
Nonetheless, a petition accused him of robbery, kidnapping, aggravated assault and aggravated battery.
But an order indicates that is one of at least six cases affected because Charlie McDaniel was found not mentally competent.
Juvenile Court Judge Willie Lovett said that basically put the case on hold and because of the combination of how the juvenile code works and lack of resources, McDaniel was released back on the street with a treatment plan before the murder.
Adeline Alexander told Winne she sees many cases as juvenile court conflict defender and incompetency worked against McDaniel.
“It did. Because based on the lack of resources and what we had to eventually do which was release him from jail, that was what had him in the situation where he picked up this case. [The murder case]? The murder case,” Alexander said.
Honestly, how does a court find a thug “mentally incompetent” when he’s been arrested so many times for serious crimes? And lack of resources for crime prevention? Atlanta has long been run by Democrats. No wonder this kind of thing can happen. And a citizen who stepped up to help stop crime in the city is now dead because liberal policies allowed a thug, criminal gang banger go free.
Maybe Trump can take over the city because it sure as hell needs some serious leadership.
