Our very own Senior Airman (Ret) Brian Kolfage has been under an onslaught of defamatory and abusive attacks against himself and his family. These people who have been targeting his family have said some of the most heinous things you could ever imagine. They have hidden behind their fake names and created 50+ Facebook pages just to attack him and his family, including his newborn child who was 1 month old at the time the attacks began. Some of the attackers cloned or spoofed his Facebook page and posted racist remarks all over the internet in a clear attempt to ruin his name and even his charity which gives back to severely wounded veterans.

“While many people might think their comments on social media and websites aren’t subject to defamation laws, that’s not necessarily the case, said Paul Eckstein, an attorney who specializes in media law with the Phoenix office of the law firm Perkins Coie.
“In today’s world you’ve got the old rules and people trying to adjust to them,” Eckstein said. Posting comments online could be considered publishing content because multiple third parties have access.
Eckstein said a case could be made that the statements published about Kolfage were done with malicious intent. “This is pretty dangerous for the defendants if it ever goes to a jury,” he said.”
They have went as far as creating falsified blog/news stories that labeled Brian as a racist and a plagiarist. One person cloned his page just to leave racist comments all over the internet in his name so it appeared that he said the comments. They falsified screenshots of his website and took items out of context to say he plagiarized news reports on this website when clearly they were ‘excerpted’ content. According to the law suit which I reviewed, they attacked out of pure malice (revenge), with no regard for factual information. They utilized their fictitious news reports in a scheme to get him expelled from the University of Arizona and his Pat Tillman Scholar program, which they failed at. The University of Arizona saw “no merit to their claims” and handed over all documents to Brian since it’s part of his student file. Additionally, Brian was selected to be in documentary about bullying and the producers were going to allow him to share his story, however, these people attacked the producers and agents of the other parties involved and sent them the false and defamatory news articles that labeled Brian as a racist. Due to the attacks Brian was let go, and lost out on a major payday. Unfortunately for the attackers we have laws in place that make this behavior extremely illegal, its known as Tortious Interference with Contracts. If the defendants want to battle it out in court this will be a major blow to anyone trying to fight him since the producers have handed over all transcripts to Brian and his legal team, caught with the hand in the cookie jar is a way of looking at it. He further related this is purely a defensive posture to stop attacks and does not wish to seek damages, however, if they decline to remove falsified defamatory content he will seek a court date and pursue maximum damages for the loses he and his family received from the attacks
