An incident from nearly a year ago is prompting a snowflake to continue a temper tantrum long after a judge has dismissed the majority of his case.  A man by the name of Daniel Black filed a federal civil rights lawsuit against former Milwaukee County Sheriff David A. Clarke, Jr. Clarke, along with several unnamed deputies and Milwaukee County were all named as defendants in the suit stemming from a brief run-in on an airplane.

24-year-old Black claimed in his lawsuit that he was the victim of an unlawful stop and arrest at Mitchell International Airport on January 15, 2017. He claims he was detained, interviewed and escorted out of the airport by a half-dozen deputy after a mere head nod at Clarke on a plane. The lawsuit asked for unspecified damages as a result of alleged violations of Black’s Constitutional rights to equal protection and freedom from unreasonable searches and for “emotional distress and other compensatory damages.”

Black and Clarke were on the same Dallas to Milwaukee flight on January 15, 2017, when Black saw Clarke on the plane decked out in Dallas Cowboys gear.  Black then asked him if he was David Clarke.  Clarke confirmed he was the same, and Black shook his head at Clarke. The suit says, and then Clarke asked Black if he had a problem. Black says in the suit that he responded by saying he did not and turned and walked to his seat in the coach section of the airplane.  The flight itself was uneventful, however, upon landing in Milwaukee, the fireworks began.

When the plane landed in Milwaukee, Black was greeted by six sheriff’s deputies, identified in the lawsuit as “John Doe”.  Clarke directed the deputies to take Black aside and question him surmising that his questioning of Clarke’s identity and subsequent disapproval may signify Black meant potential harm. The deputies then escorted Black from the airport.  Black then put Clarke on blast on social media posting about the incident.  Clarke responded on social media calling Black a “snowflake” for his reaction to the incident.

Black filed a lawsuit shortly thereafter claiming violations of his Fourth Amendment right against unreasonable seizure, retaliation for exercising his First Amendment rights by having him stopped at the airport and the subsequent mockery on Facebook, and his due process rights under the 14th Amendment. The suit also sought to have the county held liable for Clarke’s actions. Black claimed via his lawsuit that Sheriff Clarke singled Black out for his political opinions, despite Black’s own testimony that he actually walked up to Clarke and asked his identity.

Black identifies as a liberal and supported Senator Bernie Sanders (I-VT) in his bid for the presidency in 2016, while Clarke himself was and is an avid supporter of President Donald Trump. The suit describes Clarke’s actions as “irrational and unrelated to any legitimate government purpose.”

Last year U.S. District Judge J.P. Stadtmueller, a Reagan appointee, dismissed the majority of the charges.  He granted a summary judgment to Clarke on the Fourth and one of the First Amendment claims.  He dismissed the 14th Amendment claim as “completely without merit” as well as dismissing the claims against the county and the six sheriff’s deputies originally identified as “John Doe”.

Stadtmueller stated in his 27-page ruling on Friday – “While Clarke’s actions reflect poor judgment, they do not shock the conscience,” therefore did not support any level of due process claim.  The judge also determined that Black’s some 15-minute conversation with deputies could not be labeled a “seizure” as the sheriffs never drew their firearms, used “friendly” language and were not expecting nor did they arrest or cite Black for anything whatsoever.

However, Judge Stadtmueller has allowed the claim that Clarke retaliated against Black on social media, therefore, prohibiting Black’s free exercise of his first amendment rights to shake his head at Clarke to survive.  The trial for this allegation is currently set to start on January 22, 2018. The Judge will allow a jury to decide if Clarke’s reaction to Black’s post on Facebook about the incident in the Milwaukee airport was intended to be any level of threat or intimidation that amounted to retaliation against Black.

The lawsuit alleges that by taunting Black via a social media platform, Clarke misrepresented what happened on the Dallas flight and his comments on social media were intended to “incite violent verbal assaults against Black, which has happened.”

It seems as a result of this lawsuit, the FBI used it as the impetus to pursue an investigation into Sheriff Clarke. On March 7th, FBI Special Agent Jennifer Walkowski applied to search Clarke’s Gmail account, saying there was evidence of a crime. A judge approved the warrant, and the FBI carried out the search the next day.

On May 3rd, the U.S. Attorney’s office decided not to pursue criminal charges against Clarke, saying it would be difficult to prove the then-sheriff had broken federal civil rights laws. Local Milwaukee news affiliate Fox 6 Now reports how Clarke initially wanted to respond to the incident concerning Black as revealed in the FBI’s search warrant application –

On January 17th, the sheriff ordered a subordinate to write a Facebook post about Black that read, “Sheriff has taken this (expletive’s) complaint under advisement and summarily determined that he can go to hell.”

The subordinate responded that the sentence could not be posted to Facebook.

According to the FBI document, Clarke responded, “Can’t? Is there a computer problem?”

The post that was ultimately published on the Milwaukee County Sheriff’s Office Facebook page did include this comment from Clarke: “Next time he (Black) or anyone else pulls this stunt on a plane they may get knocked out.”

It seems Black’s mouth may have written checks his behind was unwilling or unable to cash and now he is attempting to use the former Sheriff Clarke to garner notoriety as well as financial gain. Hopefully, all will be revealed in the trial beginning on January 22 and justice will be served.

For the past several days #ReleaseTheMemo has been trending on social media as conservatives across the country are demanding the release of the newly discovered damaging report. Over the weekend that traction only gained further steam as more people began to echo this phrase causing the Deep State to tremble in their treasonous boots. In the past, the left may have been able to sweep this memo under the rug, but that changed after what was released today. Another stunning report surfaced earlier today that shows that text messages between disgraced FBI agent Peter Strzok and his mistress Lisa Page’s went missing right around the time that Robert Muller was appointed to oversee the Russian Collusion investigation.

With this new information brought to light the memo has been pushed further into the spotlight, and now we have time when it is expected to be released, and it is sooner then you think.

Americans across the country have been eagerly awaiting the release of the anticipated memo that according to all that have seen it say it is worse then they could have ever imagined. The memo details the FISA surveillance abuses that were conducted under the Barack Obama administration, and how they used these secret courts to spy on a presidential candidate and use lies to make that happen.

Early on Monday morning, Congressman Dave Joyce appeared on Fox & Friends where he stated that he had seen the memo and its contents were “deeply disturbing.” Joyce was asked in the interview if the contents of the memo would be cause for termination of anyone involved in this scandal, which prompted Joyce to respond with, “termination would be the least of these people’s worries,”

Then when Joyce was asked if people would go to jail, he responded with, “They should.”

Now, how bad is this memo?

Joyce added, “Every American…would be surprised how bad it is.”

According to Joyce, the memo has been making its rounds through Congress for a bit now, and the contents enclosed in this memo has stunned almost every member of Congress who has read it.

Now, many of us are wondering why would the release of this damaging memo take that long since we have the right to know what is going on behind the closed doors in our government. Well, to give more answers on why we may have this delay of two to three weeks here is more from Washington Examiner.

House Judiciary Committee Chairman Bob Goodlatte and House Oversight Committee Chairman Trey Gowdy met with House Intelligence Committee Chairman Devin Nunes over the weekend to discuss next steps for the memo that details alleged abuses by the Intelligence Committee.

According to a committee source, no final decision was made on making it public because the three want to give lawmakers “who haven’t read it yet a chance to do so and weigh in.”

If a decision is made for a public release, the timeframe would probably be two to three weeks, the source told the Washington Examiner.

The four-page report, which was made available to the entire House on Thursday and has since been viewed by at least 180 members as of Sunday, is said to outline misuse of the Foreign Intelligence Surveillance Act by the Obama administration.

Meanwhile, the FBI has yet to see the memo.

“The FBI has requested to receive a copy of the memo in order to evaluate the information and take appropriate steps if necessary. To date, the request has been declined,” FBI spokesman Andrew Ames told the Washington Examiner.

Unnamed individuals who spoke with the Washington Post said the memo contains assertions that seek to discredit Fusion GPS, the opposition research firm that hired former British spy Christopher Steele to author the largely unverified “Trump dossier.”

The document reportedly says the FBI included false claims from Steele about Trump associates’ ties to Russia in an approved application to spy on campaign adviser Carter Page.

While everyone is waiting on the contents of this memo, some people have taken to Twitter to give their thoughts on how the note should be released, and I must say some of them are great ideas.

This memo could be the game changer we have all been waiting for over the last year.

It is about time that the American people know just how destructive Barack Obama and his minions were and how they were the ones obstructing justice in our country. Obama, Hillary Clinton, and the rest of those involved in this shocking abuse of power deserve to answer for their crimes once and for all and maybe now we will be able to see that happen.

BREAKING!! TRUMP’S DOING IT ON MARCH 5th!!! DREAMERS ARE DONE!

There has been a tremendous amount of concern regarding the government shutdown and what brought it about. Primarily, it was DACA, Dreamers, and the issue of illegal immigration. Democrats shut down the government because DACA kids weren’t included in the budget. Which has everyone wondering what’s going to happen now that the budget has been extended for a month on the promise that DACA will be taken care of.

White House Press Secretary Sarah Huckabee Sanders said during a White House press briefing that it is possible starting March 5th that Dreamers could start getting deported. This is if Democrats don’t comply with the demands of President Trump regarding chain migration. Sanders said,

We haven’t determined that. We are hopeful we don’t have to do that and we don’t have to get there. We would like Democrats to get serious about solving problems.”

Now Congress has six weeks until the continuing resolution before the budget runs out. Only six weeks to figure out United States immigration policy and deal with the 690,000 DACA kids currently in this country. If they weren’t able to figure this out in October or the last four times they passed a continuing resolution what is going to make them figure it out in less than a month?

When asked about the status of Dreamers and the message the administration is sending to them in light of everything that is going on Sanders replied,

I think they should storm capitol hill and protest there because that is the place that has held up this discussion. Democrats are the one who shut this discussion down by forcing a government shutdown, by being unwilling to fund the government. We lost four days over this process of the conversation that should have been focused on immigration reform, fighting over this CR. If they had been part of the solution instead of part of the problem, I think we would already be further down the road in our negotiation on this package.”

The Daily Mail reported,

Sanders said Monday that Democrats in the Capitol ‘held up’ discussion about DACA, which gives at least 700,000 people a guarantee they won’t be deported unless they commit crimes. ‘Democrats are the one that shut this discussion down by forcing a shutdown, by being unwilling to fund the government,’ she insisted. Sanders framed DACA recipients’ worries as products of a ‘failure to actually address the issue’ on Capitol Hill.

‘They’re the ones that actually pass and make those laws,’ she said of Congress.
‘And the president gave a six-month timeframe in order for them to do that. And now I think all of America is counting on them to show up and make sure that happens.’ The DACA program’s uncertain fate continues to serve as leverage for the president to demand funding to construct a wall between the U.S. and Mexico.

He also wants an end to ‘chain migration,’ a system that allows green card holders to sponsor large numbers of relatives for lawful admission into the U.S. And Trump is demanding that Congress scrap a diversity visa lottery that awards residence and work permits to people who come from ‘underrepresented’ countries. He has said he prefers a ‘merit-based’ system that pays no notice to anyone’s country of origin. Trump’s wall in particular, a constant campaign promise that consistently riled up crowds in 2015 and 2016, has become a sticking point for many Democrats.

At least one outspoken congressional advocate for illegal immigrants, however, is willing to grudgingly go along. ‘I think the wall is a monumental waste of taxpayers’ money, and it’s to build a monument to stupidity and it’s just idiotic,’ Rep. Luis Gutierrez of Illinois said Sunday on ABC. ‘Having said that, if that’s what it’s going to take in order to put 800,000 young men and women in the country … in a safe place and put them on course to full integration in our society … I say pay it.'”

While DACA protections will likely diminish starting March 6th, and the likelihood that some deportations will take place is high, Democrats only have themselves to blame. They have had since October to try and negotiate a DACA deal yet they have held out until now to push for a government shutdown. It makes no sense other than to call it a publicity stunt.

They are willfully holding the American people hostage over DACA kids who only account for 690,000 people out of the population. While the Children’s Health Insurance Program is something that 8,500,000 children are covered by. Democrats willingly putting the lives of 8,500,000 children at risk all to protect 690,000. The numbers just don’t add up no matter which way you spin it. There is no excuse for what they did.

The government has been shut down for three days. But it is expected to reopen tomorrow. Senate Democrats forced the shutdown by filibustering on Friday. Thus, over the weekend long and bipartisan talks took place over how to end the shutdown. Eventually, both sides came to an agreement.

The government shutdown came about because Senate and House Democrats wanted DACA funding included in the continuing resolution budget package. However, it was not in it. Even though they agreed with everything else in the budget including extending Children’s Health Insurance Program funding for six years. Democrats refused to end the shutdown until DACA was discussed while President Trump insisted he would not negotiate DACA until the government was reopened.

The Independent Journal Review reported,

On Monday, the Senate voted to end the government shutdown after just three days of being unable to reach a deal on the Deferred Action for Childhood Arrivals program and immigration reform. President Donald Trump repeatedly said that funding for the border wall would need to be included in the deal, and Schumer argued for DACA to be included, as well.

In the end, Schumer gave in to a plan where Democrats would accept a deal to end the shutdown in exchange for opening negotiations on DACA. The vote landed at 81-18.
Now Trump has issued a statement saying that Democrats had finally “come to their senses” to fund the military, border patrol, first responders, and insurance for vulnerable children. He then said his administration would “work toward solving the problem of very unfair illegal immigration,” but only if “it is good for our country.””

The President spent the weekend at the White House residence on standby should the Senate finally come to a conclusion. They did, however, it wasn’t until Monday when a decision was made. While at the White House the President was reported to be restless while on the phone with Republican legislators and some informal congressional aides.

While some took issue over his notable absence from the discussions he did exactly what he was supposed to. It isn’t his job to craft a budget, it is Congress’ job. His role is more of a principal, a lender of last resort, the last person you want to go to. Going to him indicates a failure on the part of Congress and the Senate to do their job and negotiate a bill that could pass. In the end, he won and thereby the American people won.

USAToday reported,

Yet Democrats on Monday made their own case for at least a partial victory. They noted that the new spending plan lasts less than three weeks, winning them a commitment to work on a permanent resolution to the issue of DREAMers, the undocumented immigrants who came to the U.S. as children.

If there’s no agreement by Feb. 8, they warned, there could be a rerun of what Democrats called the “Trump shutdown,” which took place as both parties positioned themselves for congressional elections in a little less than ten months. “The Republican majority now has seventeen days to prevent the DREAMers from being deported,” said Senate Democratic leader Charles Schumer, D-N.Y., speaking on the Senate floor.

On Monday, Senate Democrats came together with Republicans on a short-term government funding bill — with a promise from Senate Majority Leader Mitch McConnell, R-Ky., to work toward a bipartisan compromise on immigration, border security, and a broader budget outline before then. The vote was 81-18. 

Sanders said Trump hopes to sign the bill later Monday, after the House votes on the short-term spending measure and the budget office does necessary paperwork. Shortly after the vote, Trump met at the White House with a group of Senators — all Republicans, and all viewed as relative hard-liners on the immigration.  The government has been partially shut down since 12:01 a.m. Saturday, after senators blocked a bill that would have kept the government funded for the next month. The legislation came up with a vote of 50-49 – about 10 votes short of overcoming a Democratic filibuster.

Democrats opposed the bill in part because it did not include provisions for young immigrants protected under the Obama-era Deferred Action for Childhood Arrivals program known as DACA. Trump announced in September that he would end the program, saying Obama didn’t have the legal authority to give the undocumented immigrants legal status. But he also gave Congress six months to enshrine the program into law. 

Democrats argued the president was backing away from his commitment to finding a solution to help protect these 800,000 immigrants from deportation. “We expect that a bipartisan deal on DACA will receive fair consideration and an up-or-down vote on the floor,” Schumer said Monday. Trump himself has been largely silent throughout the shutdown crisis, except for an occasional tweet. But across the globe, Vice President Pence was quick to cast Democrats’ efforts as a loss. “The Schumer shutdown failed,” Pence said during a news conference in Israel, placing the blame squarely on the top Senate Democrat. “Now that the government is reopening, Congress can get back to work advancing the president’s agenda.””
